1 Purpose and acceptance
These conditions govern access to the www.realtycare.be, site, consultation and use of its functionalities. Access to the site implies respect for them. They do not replace a brokerage mandate, nor a management mandate, nor an offer, nor a compromise, nor a lease, nor any other contract concluded with RealtyCare.
RealtyCare may modify these conditions to take into account changes to the site or applicable law. The version published at the time of consultation is applicable.
2 Real estate information and lack of commitment
RealtyCare strives to provide useful and regularly updated information. Announcements, estimates, photographs, plans, surface areas, town planning data, energy performance, charges, income, yields and availability, however, have informative value and may come from the owner, the candidate, an administration or a third party.
Unless expressly mentioned in a contractual document, this information constitutes neither a firm offer, nor a guarantee, nor an exhaustive study of the legal, urban planning, environmental or technical conformity of the property. The visitor is invited to check the determining elements and, if necessary, to consult a specialized professional.
Any purchase or rental offer remains subject to the conditions contained therein and to the acceptance of the seller or lessor. RealtyCare’s liability is assessed in accordance with Belgian law and cannot be excluded when exclusion is prohibited by law.
3 Access and availability
RealtyCare uses reasonable means to keep the site accessible and secure. Access may be interrupted for maintenance, updates, technical incidents, security or force majeure. No absolute continuity or compatibility with any equipment or browser is guaranteed.
4 Authorized use
The visitor uses the site fairly, lawfully and in accordance with its intended purpose. In particular, he is prohibited from:
- adversely affect the operation, security or integrity of the site;
- introduce a virus, malicious code or make an unauthorized access attempt;
- extract or substantially reuse a database, automate a collection or use the site for unauthorized prospecting purposes;
- publish or transmit illegal content, misleading, defamatory, discriminatory or infringing the rights of a third party;
- impersonate a person or communicate intentionally inaccurate information.
RealtyCare may suspend access to a functionality in the event of abuse, security risk or violation of these conditions, without prejudice to any useful action.
5 Forms, applications and accounts
The user provides accurate, complete and up-to-date information. When an account is offered, its identifiers are personal and confidential. He remains responsible for their conservation and must immediately report any suspicious use.
Sending a contact form, an estimate request, an application file or a real estate search does not guarantee the conclusion of a contract or the allocation of a property. The processing of associated data is described in the privacy protection charter.
6 Intellectual property
The structure of the site and its texts, photographs, videos, plans, databases, distinctive signs, brands, logos, software and other content are protected by the intellectual property rights of RealtyCare or their respective owners. Private consultation is permitted. Any reproduction, adaptation, extraction, distribution or exploitation beyond what is legally permitted requires prior written authorization.
7 Third Party Links and Services
The site may contain links or integrate third party services. RealtyCare does not permanently control its content, availability or practices. The user consults the conditions and policies of these third parties. Any link does not imply any endorsement or warranty by RealtyCare.
8 Security
RealtyCare applies reasonable security measures, without being able to guarantee the total absence of malware or intrusion. The user must protect their device, keep their software up to date and back up their data.
9 Applicable law and disputes
These conditions are governed by Belgian law. Mandatory consumer protection rules remain applicable. In the absence of an amicable solution, the competent courts are determined in accordance with Belgian law; no attribution clause deprives a consumer of the mandatory protection from which he benefits.
12 Mandatory nature of data and automated decisions
Certain data is necessary to respond to a request, conclude or perform a contract or comply with a legal obligation. Otherwise, RealtyCare may not be able to process the file. RealtyCare does not make decisions producing legal effects exclusively on the basis of automated processing, unless specific information is provided in accordance with the law.
13 Update
This charter can be adapted. The date of its last update is indicated at the top of the document. A substantial modification is indicated by an appropriate means.
